Kano Guber Issues :APC Files Cross-Appeal Against Court Judgment

The All Progressive Congress (APC) has recorded a two-ground cross-request at the High Court to challenge the judgment of the Court of Interest for refusal to exclude the legislative leader of Kano State, Abba Yusuf from challenging political race over supposed endorsement falsification.

In the notice of appeal filed by Akin Olujinmi, the APC lawyer, dated Wednesday, the party mentioned two grounds in its cross-appeal.
“The Lower Court erred in law when their lordships at page 11 of the judgement held thus:

Presently whether the second Cross Respondent’s Structure EC9 show qualifies as a declaration under Segment 182[1] [j] of the Constitution of the Government Republic of Nigeria, 1999 [as amended] isn’t of any utilitarian advantage or worth to the cross-litigant,” Olujinmi said.

Refering to the specifics of the mistakes in the judgment, Olujinmi added, “In opposition to the holding of the lower court, a choice on it goes to the issue on non-capability of the second cross-respondent to challenge the political race in question in this allure.”

The APC, notwithstanding, looked for a request from the High Court to permit the cross-offer.
